- Section 504 of the Rehabilitation Act is a federal civil rights statute which protects the civil and constitutional rights of persons with disabilities and ensures that a child with a disability has equal access to a Free Appropriate Public Education (FAPE).
- Section 504 is a non-discrimination statute that addresses discriminatory actions such as different treatment, denial of access, disability-based harassment, and requires that disabled persons be provided equal opportunities as non-disabled persons. It is designed to provide equal opportunity.
Who is eligibile for a 504?
- Any student who has a physical or mental impairment that substantially limits one or more major life activity (such as: walking, talking, breathing, seeing, hearing, etc)
What is a physical or mental impairment?
- A physical impairment can be any physiological disorder or condition, cosmetic disfiguration or anatomical loss.
- A mental or physiological disorder, emotional or mental illness. Examples: behavior disorder, ADD/ADHD, HIV/AIDS, diabetes, asthma, allergies, physical disabilities, hearing impairments.
Who can refer a child for a 504?
- Teachers, administrators, parents, child (can refer self), and intervention team
What should you do if you believe a referral is necessary?
- If you believe your child or student requires a 504 based on a disability that substantially limits one major life activity, then please contact the appropriate counselor.
